APPELLATE SECTION

DESCRIPTION:

Overview

In cases and matters within the jurisdiction of the Criminal Division, the Appellate Section is responsibile for: preparing draft briefs, certiorari petitions, and jurisdictional statements for the Solicitor General for filing in the Supreme Court; reviewing adverse decisions in the district courts and courts of appeals and recommending to the Solicitor General whether further review is warrented; and preparing briefs and arguing cases in the courts of appeals.

The Section assists the U.S. Attorneys and Division prosecutors in preparing briefs for the courts of appeals and provides advice on Speedy Trial Act problems and variety of other legal issues.

All adverse decisions in criminal prosecutions must be reported to the Appellate Section so that appropriate strategies for appeals can be developed and the Solicitor General can determine whether further review is warrented.

NARCOTIC AND DANGEROUS DRUG SECTION (NDDS)

DESCRIPTION:

Overview

The Narcotic and Dangerous Drug Section oversees the prosecution of high-level drug traffickers engaged in the importation, manufacture, shipment, and distribution of illicit narcotics and dangerous drugs, as well as the forfeiture of the illicit proceeds of such activity. The Section maintains a litigation staff to prosecute, nationwide, complex cases against major drug-traffickjing organizations. It also coordinates and participates in the prosecution of multi-district cases. Section attorneys provide general support to the U.S. Attorneys' Offices and advice on specialized investigative and prosecutorial techniques.

The Section drafts and evaluates proposed drug-related legislation and analyzes and executes the Criminal Division's drug prosecution policies. In addition, the Section reviews the feasibility of all drug-related electronic surveillance requests, assists in securing witnesses from foreign jurisdictions, and participates in training programs for investigators and prosecutors.

ASSET FORFEITURE OFFICE (AFO)

DESCRIPTION

Overview

The Asset Forfeiture Office assists federal prosecutors with civil and criminal forfeiture litigation by providing advice and guidance, research assistance, sample briefs and pleadings, and when requested, handling the forfeiture prosecution in complicated cases. The Asset Forfeiture Office reviews major compromise settlements and all requests to appeal adverse forfeiture decisions. The Office also approves requests for pre-indictment restraining orders on property subject to forfeiture and coordinates international forfeiture activities. The Attorney General has delegated his authority to decide petitions for remission or mitigation of judicial forfeitures to the Asset Forfeiture Office. In addition, the Office processes most major requests from state and local agencies for an equitable share of forfeited property in joint investigations.

Through the Criminal Fine Collection Unit, the Asset Forfeiture Office supervises the collection of criminal fines, criminal penalties, and appearance bond forfeitures in Criminal Division cases, monitors the crimnial fine collection activities of the U.S. Attorneys' Offices, and provides advice and support to federal prosecutors on request.

OFFICE OF THE ASSISTANT ATTORNEY GENERAL

DESCRIPTION:

Overview

The Criminal Division develops, enforces, and exercises general supervision over all Federal criminal laws except those that are specifically assigned to other divisions. The Division oversees criminal matters under more than 900 statutes, and supervises certain civil litigation.

The Criminal Division is organized into seven sections and seven offices, specializing in particular areas of criminal law. In addition, the Division houses the National Obscenity Enforcement Unit.

The Division is supervised by an Assistant Attorney General, who has the following responsibilities: advising the Attorney General on matters concerning criminal law; monitoring sensitive areas of criminal law requiring coordination, such as attorney subpoenas and attorney fee forfeitures; providing top level representation of the Division to Congress, the Office of Management and Budget, and the White House; maintaining top-level liaison with United States Attorneys and Federal investigative agencies; establishing and implementing criminal law enforcement policies; and providing leadership for coordination of federal-state-local law enforcement relationships.

FRAUD SECTION

DESCRIPTION:

Overview

The Fraud Section is charged with directing the Federal law enforcement effort against fraud and white collar crime. The Section assumes direct responsibility for conducting gand jury investigations and prosecutions in certain cases that require centralized treatment because of the complexity of the scheme, the multi-district nature of the criminal activity, the sensitivity of the issues, or the necessity for developing model prosecutions to establish the viability of a particular statute, theory, or technique.

When required, because of local lack of expertise or resources, the Section provides on-site litigation support to U.S. Attorneys. The Section provides assistance in developing investigative and prosecutorial strategies and in preparing or reviewing motions, briefs, or othe documents, as resources permit. It also fashions and implements white collar crime policy, provides legal and investigative guidance to the attorneys in the Criminal Division and U.S. Attorneys' Offices, and coordinates information-sharing about white collar crime with state and local law enforcement agencies.

GENERAL LITIGATION AND LEGAL ADVICE SECTION (GLLA)

DESCRIPTION:

Overview

The General Litigation and Legal Advice Section has broad criminal jurisdiction encompassing approximately 75 percent of all Federal criminal statutes and also has a variety of civil responsibilities. The areas handled by the section include: crimes against government operations, crimes against the public, regulatory enforcement, terrorism, post-conviction and special matters, and special civil matters.

The Section provides legal advice on statutes within its jurisdiction to U.S. Attorneys' Offices as well as to investigative and client agencies. The Section may also become directly involved in case development and litigation because of recusal or lack of resources or pertinent expertise in a particular U.S. Attorney's Office, or where the requirements of a specific case dictate the need for centralized prosecution.

The Section participates in the Working Group on Environmental crimes, a joint Criminal Division - Land and Natural Resources Division effort to focus on the investigation and prosecution of environmental criminal cases involving fraud against the government, drugs, public corruption or organized crime.

INTERNAL SECURITY SECTION

DESCRIPTION:

Overview

The Internal Security Section oversees the enforcement of criminal statutes affecting national security, foreign relations, and the administration and enforcement of the Foreign Agents Registration Act and related statutes. The Section supervises the investigation and prosecution of offenses within its jurisdiction, and serves as the focal point for interagency coordination in cases such as espionage, neutrality, and arms and strategic technology export control violations.

Section 9-2.132 of the U.S. Attorney's Manual provides that cases affecting national security and foreign relations are not to be instituted or declined without the express authorization of the Criminal Division or higher authority. The Internal Security Section must be contacted before any action is taken in such cases.

In addition to authorizing action on relevant cases, the Section provides specialized legal support to U.S. Attorneys in policy interpretation, legal research and drafting indictments, pleadings and other legal papers. Where appropriate, Section attorneys are available to provide on-site assistance.

Overview

The Organized Crime and Racketeering Section coordinates investigations and prosecutes cases related to organized crime, acting through 14 Strike Forces and 10 Strike Force Field Offices around the country. In addition, staff in Washington, D.C. do research and provide advice and assistance to U.S. Attorneys on a wide variety of investigative and prosecutorial issues and strategies.

From its Washington headquarters, the Section administers all Federal criminal statutes dealing with labor racketeering, loansharking, extortion, gambling, prostitution, liquor, and cigarettes and is responsible for approving all RICO indictments.

PUBLIC INTEGRITY SECTION

DESCRIPTION:

Overview

The Public Integrity Section oversees the investigation and prosecution of election crimes and Federal crimes involving abuse of public trust by elected or appointed public officials at all levels of government. The Section prosecutes selected cases against Federal, state, and local officials and provides assistance to U.S. Attorneys as appropriate.

In particular, the Section will prosecute or directly supervise prosecutions in cases where the U.S. Attorney must recuse himself. The section will also provide attorneys to serve as lead or co-counsel where there is insufficient manpower or expertise in a U.S. Attorney's Office to undertake a significant corruption case; Section attorneys will also become actively involved in sensitive matters and in matters that extend over district lines to ensure appropriate coordination. Section attorneys are available to provide advice on substantive questions and investigatory methods and to assist in drafting or reviewing indictments, motins, or other legal documents.

Specific authorization by the Public Integrity Section is required in all election-related cases, and in corruption cases brought under the Hobbs Act.

DESCRIPTION:

Overview

The Office of Enforcement Operations oversees the effective use of the most sophisticated investigative tools at the Department's disposal -- including electronic surveillance and authorizations of witness immunity. The Office provides the U.S. Attorneys' Offices and the various components of the Division with a wide range of litigative assistance and prosecutive support.

The Office also administers the Witness Security Program, propares the Division's responses to requests under the Freedom of Information Act and the Privacy Act, and maintains an extensive collection of legal reference and legislative history materials.

OFFICE OF INTERNATIONAL AFFAIRS (OIA)

DESCRIPTION:

Overview

The Office of International Affairs supports the Criminal Division in the formulation and execution of international criminal justice enforcement policies. The Office participates in the negotiation of international agreements and treaties relating to criminal law enforcement, extradition, mutual legal assistance, and prisoner transfer.

The Office provides advice and assistance to U.S. Attorneys, state attorneys general, and local district attorneys on international foreign practice and procedure, strategies for securing extradition or evidence from foreign countries, and preparation of necessary documents. The Office coordinates and reviews all requests (to and from foreign governments and courts) to obtain evidence for criminal matters under investigation or secure extradition of specific parties. The Office also supervises prisoner transfers to and from the United States.

U.S. Attorneys should contact the Office of International Affairs regarding all criminal matters requiring assistance from a foreign country, prior to any official contacts regarding criminal matters with State Department officials, foreign officials or officials of international organizations, and prior to initiating official foreign travel in connection with criminal matters. In appropriate situations, the Office of International Affairs will refer inquiries to the substantive experts in other Criminal Divisions sections and offices.

OFFICE OF LEGISLATION

DESCRIPTION:

Overview

The Office of Legislation is responsible for developing and supporting the Criminal Division's legislative program. The Office prepares legislative proposals, legal memoranda, and testimony to be presented to Congress and draft responses to requests from Congressional Committees and governmant agencies for Division comments on pending and proposed legislation. The Office maintains liaison with Congress to monitor legislative activities and provides advice on admendments to the Federal Rules of Criminal Procedure.

The Office also prepares legal memoranda and assists in developing guidelines and operating manuals relating to the implementation of recently enacted statutes. When legislation is pending or newly enacted, the Office of Legislation serves as the initial contact point for inquiries by U.S. Attorneys regarding substance and status.

The responsibility for providing information about and interpreting new legislation is typically assigned to the appropriate Section(s) or Office(s) in the Division shortly after its enactmnet. Because the Office of Legislation has a very small staff, U.S. Attorneys are encouraged to direct inquiries to the Section or Office that is responsible for the area of criminal law in question.

NATIONAL OBSCENITY ENFORCEMENT UNIT

DESCRIPTION

Overview

The National Obscenity Enforcement Unit coordinates federal obscenity and child pornography prosecutions. In addition, the Unit collects and disseminates instructional and reference materials, provides legal advice and opinions, prosecutes cases, and works with state and local law enforcement organizations to ensure effective enforcement of relevant statutes. The Unit is divided into two groups: the Federal Obscenity Task Force and the Obscenity Law Center.

The Federal Obscenity Task Force includes attorneys based in Washington who prosecute cases involving child pornography and the organized criminal production and distribution of obscene materials. These attorneys provide advice on investigative and prosecutorial strategies and other relevant assistance to Federal prosecutors and also supply expertise and legal advice to state and local law enforcement agencies n request. An attorney in each U.S. Attorney's Office and in each Organized Crime Strike Force has been designated to work with the Task Force and provide assistance and coordination in the field.

The Obscenity Law Center collects and disseminates a wide variety of informational materials related to the enforcement of child pornogrphy and obscenity laws at all levels of government. These materials are available, as appropriate, to prosecutors, investigators, community groups and the public-at-large and include: sample briefs and forms, trial transcripts, model sentencing nenoranda, statistical information, social science research reports, and information on state and Federal statutes and court opinions. In addition, the Center organizes training seminars and maintains a public information program, including a Speakers Bureau.
