 HIS REQUEST TO MAKE AVAILABLE APPROPRIATIONS TOTALING $32,200,000 IN 
BUDGET AUTHORITY FOR THE DEPARTMENTS OF HOUSING AND URBAN AFFAIRS, AND 
  COMMERCE, AND TO DESIGNATE THESE AMOUNTS AS EMERGENCY REQUIREMENTS 
    PURSUANT TO SECTION 251(b)(2)(D)(i) OF THE BALANCED BUDGET AND 
   EMERGENCY DEFICIT CONTROL ACT OF 1985, AS AMENDED, PURSUANT TO 31 
                              U.S.C. 1107

The Speaker of the House of Representatives.
    Sir: In accordance with provisions of P.L. 103-327, the 
Departments of Veterans Affairs and Housing and Urban 
Development, and Independent Agencies Appropriations Act, 1995, 
and P.L. 103-317, the Departments of Commerce, Justice, and 
State, the Judiciary, and Related Agencies Appropriations Act, 
1995, I hereby make available appropriations totaling 
$32,200,000 in budget authority for the Department of Housing 
and Urban Development and the Department of Commerce. These 
funds will be used to assist communities in recovering from the 
flooding and associated damage caused by Tropical Storm Alberto 
and will be available immediately.
    I designate the amounts made available as emergency 
requirements pursuant to section 251(b)(2)(D)(i) of the 
Balanced Budget and Emergency Deficit Control Act of 1985, as 
amended.
    The details of this action are set forth in the enclosed 
letter from the Director of the Office of Management and 
Budget. I concur with her comments and observations.

The White House.
    Submitted for your consideration are requests to make 
available emergency appropriations for the Department of 
Housing and Urban Development (HUD) and the Department of 
Commerce. Your approval of these requests would make available 
previously appropriated funds to HUD and Commerce in order to 
assist communities in Florida and Georgia to recover from the 
flooding and associated damage caused by Tropical Storm 
Alberto.
    Public Law 103-327, the Departments of Veterans Affairs and 
Housing and Urban Development, and Independent Agencies 
Appropriations Act, 1995, includes a $180 million contingent 
emergency appropriation for the Community Development Grant 
program. The availability of these funds was made contingent 
upon the President submitting a budget request to the Congress 
and designating the entire amount requested as an emergency 
requirement. None of the $180 million has yet been designated 
as an emergency requirement and made available. Of the total 
available, $22.2 million is now needed to assist Florida in the 
acquisition and relocation of damaged homes and public 
facilities and to aid in the economic recovery of the oyster 
industry of Franklin County.
    Public Law 103-317, the Departments of Commerce, Justice, 
and State, the Judiciary, and Related Agencies Appropriations 
Act, 1995, provided a contingent emergency appropriation of $55 
million for the Economic Development Administration. The 
availability of these funds was made contingent upon the 
President submitting a budget request to the Congress and 
designating the entire amount requested as an emergency 
requirement. None of the $55 million has yet been designated as 
an emergency requirement and made available. At this time, $10 
million is needed to increase capacity at a Macon, Georgia, 
water treatment plant at its new site--off the floodplain, on 
higher ground.
    I recommend that you designate these requests as emergency 
funding requirements in accordance with section 25(b)(2)(D)(i) 
of the Balanced Budget and Emergency Deficit Control Act of 
1985, as amended.
    I have carefully reviewed these proposals and am satisfied 
that they are necessary at this time. Therefore, I join the 
Secretary of Housing and Urban Development and the Secretary of 
Commerce in recommending that you make the requested funds 
available by signing the enclosed letter to the Speaker of the 
House of Representatives. No further congressional action will 
be required.

Department of Housing and Urban Development:
    Community Planning and Development, Community 
      development grants................................     $22,200,000

    Title VI, Emergency Supplemental Appropriations, contained 
in Public Law 103-327, the Departments of Veterans Affairs and 
Housing and Urban Development, and Independent Agencies 
Appropriations Act, 1995, provided $180 million for the 
Community Development Grant program. The availability of these 
funds was made contingent upon the President submitting a 
budget request to the Congress and designating the entire 
amount requested as an emergency requirement. None of the $180 
million has yet been designated as an emergency requirement and 
made available. At this time, $22.2 million is needed to assist 
Florida in the acquisition and relocation of damaged homes and 
public facilities and to aid in the economic recovery of the 
oyster industry of Franklin County. Ecological damage resulting 
from the flood waters dramatically reduced the local oyster 
population.

Department of Commerce:
    Economic Development Administration, Economic 
      development assistance programs...................     $10,000,000

    Title VII of Public Law 103-317, the Departments of 
Commerce, Justice, and State, the Judiciary, and Related 
Agencies Appropriations Act, 1995, provided a $55 million

Administration. The availability of these funds was made 
contingent upon the President submitting a budget request to 
the Congress and designating the entire amount requested as an 
emergency requirement. None of the $55 million has yet been 
designated as an emergency requirement and made available. At
